COUNT 1 THEFT 3RD DEGREE
The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths present that Thomas R. Romano, on or about September 21, 2006, in the Borough of Milford, in the County of Hunterdon, and within the jurisdiction of this Court, knowingly did unlawfully take or exercise unlawful control over the movable property of John M. Gaeta, that is, Two (2) Ruger 44 Caliber Pistols and a leather gun belt with ammunition, with purpose to deprive the owner thereof, contrary to the provisions of N.J.S.A. 2C:20-3a, and against the peace of this State, the Government and dignity of the same.
COUNT 2 BURGLARY 2ND DEGREE
The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths further present that Thomas R. Romano, on or about September 21, 2006, in the Borough of Milford, in the County of Hunterdon, and within the jurisdiction of this Court, did knowingly enter a work shed structure located at 227 County Road 513, Frenchtown, New Jersey, with purpose to commit an offense therein, and was armed with or displayed what appeared to be a deadly weapon, contrary to the provisions of N.J.S.A. 2C:18-2 , and against the peace of this State, the Government and dignity of the same.
COUNT 3 UNLAWFUL POSSESSION OF A WEAPON 3rd DEGREE
The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths further present that, Thomas R. Romano, on or about September 21, 2006, in the Borough of Milford in the County of Hunterdon, and within the jurisdiction of this Court, knowingly did possess certain weapons, that is, two (2) handguns; specifically two (2) Ruger .44 Caliber Vaquero single shot pistols, without having first obtained a permit as provided as provided in N.J.S.A. 2C: 58-4, contrary to the provisions of N.J.S.A. 2C: 39-5b, and against the peace of this State, the Government and dignity of the same.
