The Grand Jurors of the State of New Jersey, for the County of Hunterdon, upon their oaths present that Johnathan Morgan, on or about July 28, 2007, in the Township of Clinton, in the County of Hunterdon, and within the jurisdiction of this Court, did purposely subject Sergeant Tracey Shimonis of the Mountainview Youth Correctional Facility, to contact with a bodily fluid, while the officer was in uniform and acting in the performance of his duties, specifically by spitting onto the officer, contrary to the provisions of N.J.S.A. 2C:12-13, and against the peace of this State, the Government and dignity of the same.
