TITLE: Heaedlight out leads to man giving officer registration and insurance in plastic bag that contained Pot???

On Sunday, August 17, at approximately 2:50 am, Patrolman David Formalarie stopped a vehicle operated by Gilbert J. Tussey, age 20, of Sussex, NJ on Route 31 South near Route 513 because Mr. Tussey’s vehicle had a headlight out. When Ptl. Formalarie requested Mr. Tussey’s driver’s license, vehicle registration, and insurance card, Mr. Tussey handed Ptl. Formalarie a plastic bag containing the documentation. Inside of this bag, Ptl. Formalarie observed a piece of marijuana. A search of Mr. Tussey’s vehicle produced an additional small amount of marijuana. Ptl. Formalarie further suspected that Mr. Tussey was under the influence of an alcoholic beverage and Mr. Tussey was unable to successfully complete roadside sobriety tests. He was arrested and his blood-alcohol concentration was found to be above the legal limit. As a result, Ptl. Formalarie charged Mr. Tussey with Possession of Under 50 Grams of Marijuana, Driving While Intoxicated, Operating a Motor Vehicle While In Possession of a Controlled Dangerous Substance, and Maintenance of Lamps. He was released to the custody of a family member and his vehicle was towed and impounded. Patrolman Christopher Weaver assisted.
