ORDINANCE NO. 08-

 

AN ORDINANCE TO AMEND CHAPTER 105 OF THE CODE

OF THE TOWN OF CLINTON TO ESTABLISH

HOURS OF OPERATION FOR TOWN PARKS AND PLAYGROUNDS

 

WHEREAS, the Town parks and playgrounds are patrolled by the Police Department to safeguard the health and welfare of those who use and enjoy those facilities; and

WHEREAS, the Police Department has requested that hours of operation be specified for each of the Town parks and playgrounds to assist them in maintaining peace and tranquility in the parks, playgrounds and surrounding areas during the evening hours;

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Clinton, in the County of Hunterdon and State of New Jersey, as follows:

Section 1.  Chapter 105 entitled “Parks” of the Code of the Town of Clinton is hereby amended to add a new Article II to read as follows:

ARTICLE II

Hours of Operation

§105-4. Hours of Operation Established.

The following hours of operation shall apply to Town parks and open space:

(a) Hunts Mills: 6:00 am to 10:00 pm;

(b) DeMott Pond: 6:00 am to 10:00 pm;

(c) Community Center and facilities: 6 am to 10 pm or the conclusion of sanctioned activities inside the Community Center;

(d) Notwithstanding the hours of operation noted above, all basketball courts, tennis courts and baseball fields shall be open to the public for play beginning at 7 am.

§105-5. Posting of notice.

The Public Works/Business Administrator or his designee shall post notice of the hours of operation of the parks and recreation facilities near the entrances to such facilities.

§105-6. Violations and penalties.

The penalties for violation of this article shall be as allowed by law.

Section 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

Section 3. If any section, phrase or portion of this ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction for any reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof.

Section 4.  This Ordinance shall take effect upon final passage and publication according to law.
